Kim Davis And The Law Of God In The Civil Sphere

Kim Davis, who is the country clerk of Rowan County in Kentucky, has become the first Christian in public office to be jailed for standing upon God's Law regarding the civil sphere. The most appalling thing to come out of this is the number of ignorant "Christians" that spelled out her doom in terms of the state with arguments justifying her imprisonment.

One of the arguments has come from the fact that she was previously divorced. The argument goes, if she had committed "sin" in her past, what right does she have to stand upon God's Law in this matter since she had broken God's Law regarding marriage and divorce? As if one must be sinlessly perfect before they can stand upon God's Law in these matters? What of repentance? Regardless, whatever "sins" Kim Davis had committed it would never negate the responsibility and duty as a Christian in these matters nor any others going forward. Does God's Law cease from being the standard because of sin? The ironic thing here is that one must actually USE THE BIBLE in order to point out any ones sins and yet the Bible is precisely what Kim Davis was standing upon while refusing to issue marriage certificates to Sodomites.

Another argument made by ignorant statist "Christians" is that if she couldn't "do her job" then she should resign because she is a public official and therefore should follow the laws that apply regarding the public. It appears today that in order for a Christian to hold public office they must either "bow" to Caesar or resign. As if God's Law has no place in the "public sphere?!" What justification for this is EVER given in Scripture? Did Daniel "bow" while holding public office? What of Shadrach, Meshach and Abednego or Peter and Paul? Did any of these men "bow" regarding God's Law?

Furthermore, if we are to get "technical" regarding the "law" that was in place in Kentucky, in 2004 there was an amendment to the Kentucky Constitution that makes it unconstitutional for the state to recognize or perform same-sex marriages or civil unions. The referendum was approved by 75% of the voters.

The text of the amendment states:

"Only a marriage between one man and one woman shall be valid or recognized as a marriage in Kentucky. A legal status identical or substantially similar to that of marriage for unmarried individuals shall not be valid or recognized."

So, what "law" was Kim Davis breaking exactly? Certainly not the law in Kentucky.

Many also argue that the Supreme Court is the "sovereign" over and above State governments. This is incorrect on many levels but more precisely, Judges do not "make law" to begin with. Judges "rule" or "give opinions" regarding the law. That also means that if a Judge "rules" unlawfully that it doesn't override the "law" as written in Kentucky's state constitution. What Sodomites will have to pull off here is to have congress pass a bill that is specifically rewriting the definition of marriage before one should argue that the Supreme Court has the final and ultimate say on this matter. However, I would argue, even if there were a state amendment that spelled out Sodomite marriage that it would no more invalidate God's Law and authority on the matter either. At what point does God's Law become subservient to men and their lawlessness? At what point did God ever surrender His "perfect law of liberty" to men and their own "thoughts" regarding matters? Fundamentally, Christians today have a flawed understanding regarding the civil sphere in relation to God's Law. God may rule in your home, in your communities, in your Churches, but NEVER in government. That particular sphere is dedicated to Caesar alone! How absurd this notion is! As if trusting Caesar rather than God has led to anything other than persecution and lawlessness.

I recall in Scripture where God's Law was spoken of as being "wisdom" to the NATIONS! To those that wish to speak of God's Law in respect to civil matters as being outdated and exclusively for Israel, where now is your "wisdom?" Where do you now go if not directly to God's perfect Law?

"Keep them and do them, for that will be your wisdom and your understanding in the sight of the peoples, who, when they hear all these statutes, will say, ‘Surely this great nation is a wise and understanding people.’" - Deuteronomy 4:6

Romans 13 speaks directly to the issue of civil magistrates and invokes the terms of "good and evil." Paul is not endorsing an autonomous notion of government here. Rather, Paul is speaking of civil magistrates enforcing "Godly" laws, which can therefore NOT BE A TERROR TO GOOD WORKS! How in the world could Paul speak of "good and evil" and NOT have the very standard of God's Law in mind!? Paul was not a relativist as many ignorant professing Christians are today! Paul was a follower of God and a teacher of God's Law. To suggest that every where else Paul uses the terms "good and evil" in respect to God's standard EXCEPT Romans 13 is to suggest that one must now use that passage to support Iran, China, or any other government that has ever existed and support them no matter if they were murdering Christians or cutting hands off for stealing.

Greg Bahnsen expounds on this by saying: “The civil magistrate cannot function without some ethical guidance, without some standard of good and evil. If that standard is not to be the revealed law of God… then what will it be? In some form or expression it will have to be the law of man (or men) - the standard of self-law or autonomy. And when autonomous laws come to govern a commonwealth, the sword is certainly wielded in vain, for it represents simply the brute force of some men’s will against the will of other men.”

Finally, I want to be very clear and plain about this: The Supreme Court is not over and above Jehovah God, nor is any man or state. There is only one "law giver." There is only ONE legislator and there can be only ONE standard regarding the civil sphere! Christians must understand that God's Law has as much place in the civil sphere as it does in your home or your church and community. The first true "government" of any society is the family. If the family must then be governed by God and His Law then how much more society in the public sphere!?

"For the LORD is our judge; the LORD is our lawgiver; the LORD is our king; he will save us." - Isaiah 33:22

We need to be praying for Kim Davis during this unlawful imprisonment but we also need to be making clear that, as Christians, there is only one "Lord" and "King" and His name is not "Obama," nor is His court called the supreme court located in D.C. His name is Jehovah God and His throne is in the heavens. We have no Lord but Jesus and no King but the true and living God of all the earth!

It is always a good and wonderful privilege to obey God rather than man! (Acts 5:29)
